江西省港口管理办法(附:英文译本)

  《江西省港口管理办法》已经2008年1月11日省人民政府第69次常务会议审议通过,现予公布,自2008年3月1日起施行。

  江西省港口管理办法

  
  第一章  总则
  
  第一条  为了加强港口管理,维护港口的安全与经营秩序,保护当事人的合法权益,促进港口的建设与发展,根据《中华人民共和国港口法》等法律、法规,结合本省实际,制定本办法。
  
  第二条  在本省行政区域内从事港口规划、建设、维护、经营、管理及其相关活动,应当遵守本办法。
  
  第三条  港口所在地县级以上人民政府应当将港口建设和发展纳入国民经济和社会发展规划,依法保护和合理利用港口资源。
  
  第四条   鼓励国内外经济组织和个人依法投资建设、经营港口,保护投资者的合法权益。
  
  第五条  省交通主管部门主管全省的港口工作,其所属的港航管理机构承担全省港口管理的具体工作。
  
  设区市、县(市、区)负责港口行政管理工作的部门,具体实施对本级人民政府管理的港口的行政管理。
  
  省交通主管部门,设区市、县(市、区)负责港口行政管理工作的部门,以下统称港口行政管理部门。  
  
  第二章  港口规划
  
  第六条  港口规划应当根据国民经济和社会发展的要求以及国防建设的需要编制,体现合理利用岸线资源的原则,符合城镇体系规划,并与土地利用总体规划、城市总体规划、江河流域规划、防洪规划、水路运输发展规划和其他运输方式发展规划以及法律、行政法规规定的其他有关规划相衔接、协调。
  
  编制港口规划应当组织专家论证,征求发展改革、规划、国土资源、水利等部门和有关军事机关的意见,并依法进行环境影响评价。
  
  第七条  港口规划包括全省港口布局规划和港口总体规划。
  
  全省港口布局规划是指全省港口的分布规划,主要明确各港口的地位、作用、主要功能等内容,促进全省港口岸线资源的合理利用。
  
  港口总体规划是指一个港口在一定时期的具体规划,包括港口的水域和陆域范围、港区划分、吞吐量和到港船型、港口的性质和功能、水域和陆域使用、港口设施建设岸线使用、建设用地配置以及分期建设序列等内容。港口总体规划应当符合全省港口布局规划。
  
  第八条  全省港口布局规划,由省人民政府根据全国港口布局规划和全省经济社会发展情况组织编制,按照《中华人民共和国港口法》的规定征求国务院交通主管部门意见后公布实施。
  
  第九条  本省列入国家主要港口名录的港口总体规划,由港口所在地的设区市港口行政管理部门组织编制,经本级人民政府审核同意,报省人民政府和国务院交通主管部门,依法由国务院交通主管部门征求国务院有关部门和有关军事机关的意见后,会同省人民政府批准并公布实施。
  
  省人民政府确定的重要港口的总体规划,由港口所在地的设区市港口行政管理部门组织编制,经本级人民政府审核同意,报省人民政府,由省人民政府征求国务院交通主管部门意见后,批准并公布实施。
  
  前两款规定以外的港口的总体规划,由港口所在地的县(市、区)港口行政管理部门组织编制,经港口所在地的县(市、区)人民政府征求省、设区市港口行政管理部门意见后,批准并公布实施,并报省人民政府备案。
  
  第十条  任何单位和个人不得擅自修改经批准公布的港口规划。因经济、社会发展需要修改港口规划的,应当按照港口规划制定程序办理。

  
  第三章  港口建设
  
  第十一条  港口建设应当符合港口规划,不得违反港口规划建设任何港口设施。
  
  第十二条  建设港口设施需要使用港口岸线的,申请人应当向港口所在地的设区市港口行政管理部门提出书面申请。但是,由国务院或者国务院经济综合宏观调控部门批准建设的项目使用港口岸线,不再另行办理使用港口岸线的审批手续。
  
  设区市港口行政管理部门应当自受理申请之日起20日内,将初步审查意见和全部申请材料报送省港口行政管理部门。省港口行政管理部门应当自收到设区市港口行政管理部门报送的申请材料之日起20日内,对属于申请使用港口非深水岸线的,作出许可或者不予许可的决定;对属于申请使用港口深水岸线的,提出审查意见,报国务院交通主管部门审批。省港口行政管理部门审查申请时,应当对使用港口岸线的合理性组织评估,并征求省发展改革部门意见。
  
  第十三条  因港口设施建设、货物装卸等需要临时使用港口岸线的,应当向港口所在地的设区市港口行政管理部门提出书面申请。设区市港口行政管理部门应当自受理申请之日起20日内,依法作出许可或者不予许可的决定。临时使用港口岸线,不得修建永久性建筑物、构筑物和设施。
  
  第十四条  港口行政管理部门对符合条件,许可使用港口岸线或者临时使用港口岸线的,应当向申请人颁发港口岸线使用证件;不予许可的,应当书面通知申请人,并说明理由。
  
  港口岸线使用期限最长不超过50年,港口岸线使用人在使用期限届满后需要继续使用的,应当在使用期限届满60日前办理延期使用手续。
  
  临时使用港口岸线期限不超过一年,港口岸线使用人在使用期限届满后需要继续使用的,应当在使用期限届满30日前办理延期使用手续。
  
  第十五条  港口岸线使用人应当按照许可的范围和用途使用港口岸线,不得擅自改变港口岸线的使用范围和使用功能。
  
  港口非深水岸线使用人自取得许可之日起连续两年未开工建设的,港口行政管理部门可以收回其港口非深水岸线使用权。港口深水岸线使用权的收回,按照国家有关规定办理。
  
  港口岸线使用人终止使用港口岸线的,应当向港口行政管理部门办理港口岸线使用注销手续。
  
  第十六条  港口建设项目应当按照国家和省有关规定向政府投资主管部门申请办理审批、核准或者备案手续,并符合国家有关标准和技术规范。
  
  建设港口工程项目应当依法进行环境影响评价和防洪影响评价。港口建设项目的安全设施、环境保护设施必须按照设计要求与主体工程同时设计、同时施工、同时投入使用。
  
  港口建设使用土地和水域,应当依照有关土地管理、河道管理、航道管理、军事设施保护管理的法律、法规以及其他有关法律、法规的规定办理。
  
  第十七条  港口工程依法实行施工安全监督和质量监督制度。港口建设工程安全监督机构应当按照有关规定,对港口工程建设安全开展监督工作。港口建设工程质量监督机构应当按照法定程序和技术标准对港口工程建设质量进行监督管理。
  
  第十八条  港口设施建设项目竣工后,项目法人应当按照国家有关规定对港口设施建设项目进行试运行,并在试运行前向港口行政管理部门备案。港口设施建设项目试运行完毕,并具备竣工验收条件的,项目法人应当按照国家和省有关规定办理项目竣工验收手续,经验收合格,方可投入使用。
  
  第十九条  港口所在地县级以上人民政府应当保证必要的资金投入,用于港口公用的航道、锚地等基础设施的建设和维护,并采取措施,组织建设与港口相配套的航道、铁路、公路、给排水、供电、通信等设施。
  
  港口行政管理部门应当加强港口公用基础设施的管理维护,并根据情况变化对港区内的船舶停泊地、锚地适时进行调整。  
  
  第四章  港口经营
  
  第二十条  从事港口经营,应当具备法律、法规、规章规定的经营条件,向港口行政管理部门申请取得《港口经营许可证》,并依法办理工商登记。
  
  港口经营包括码头和其他港口设施的经营,港口旅客运输服务经营,在港区内从事货物的装卸、驳运、仓储的经营和港口拖轮经营等。
  
  第二十一条  在设区市人民政府管理的港口申请从事港口经营的,应当向该设区市港口行政管理部门提出书面申请。设区市港口行政管理部门应当自受理申请之日起30日内依法作出许可或者不予许可的决定。
  
  在县级人民政府管理的港口申请从事港口经营的,应当向港口所在地的县(市、区)港口行政管理部门提出书面申请。县(市、区)港口行政管理部门应当自受理申请之日起10日内提出审查意见,报设区市港口行政管理部门审批。设区市港口行政管理部门应当自收到申请之日起20日内依法作出许可或者不予许可的决定。
  
  申请从事国际集装箱装卸、港口汽车滚装业务应当向港口所在地的设区市港口行政管理部门提出书面申请。设区市港口行政管理部门应当自受理申请之日起10日内提出审查意见,报省港口行政管理部门审批。省港口行政管理部门应当自收到申请之日起20日内依法作出许可或者不予许可的决定。
  
  第二十二条  港口行政管理部门实施港口经营许可,应当遵循公开、公正、公平的原则。对符合条件,许可从事港口经营的,应当向申请人颁发《港口经营许可证》;不予许可的,应当书面通知申请人,并说明理由。
  
  港口经营许可期限不得超过港口岸线使用期限。
  
  第二十三条  港口经营人从事经营活动,应当遵守有关法律、法规、规章和港口作业规则的规定,依法履行合同约定的义务,为客户提供公平、良好的服务。
  
  从事港口旅客运输服务的经营人,应当采取保证旅客安全的有效措施,向旅客提供快捷、便利的服务,保持良好的候船环境。
  
  港口经营人应当依照有关环境保护的法律、法规、规章的规定,采取有效措施,防治对环境的污染和危害。
  
  第二十四条  对载运抢险物资、救灾物资和国防建设急需物资的船舶,港口经营人应当优先安排作业。
  
  第二十五条  港口经营人不得实施垄断行为和不正当竞争行为,不得以任何手段强迫他人接受其提供的港口服务,不得为不具备经营资格、超范围经营的船舶提供装卸服务。
  
  第二十六条  港口经营人应当遵守国家有关港口经营价格和收费的规定,并在其经营场所公布经营服务收费项目和收费标准,使用国家规定的港口经营票据;未公布经营服务收费项目和收费标准的,不得收费。
  
  第二十七条  港口规费由财政部门委托港口行政管理部门征收,其收费项目、标准及管理办法,按照国家和本省的规定执行。港口行政管理部门不得擅自提高港口规费征收标准或者重复征费。
  
  第二十八条  港口行政管理部门应当收集和定期发布港口公共信息,为港口经营人、船东、货主、旅客等提供信息咨询服务。  
  
  第五章  港口安全与监督管理
  
  第二十九条  港口所在地县级以上人民政府应当加强对港口安全管理工作的领导,及时协调、解决港口安全管理工作中存在的重大问题。
  
  第三十条  港口行政管理部门应当依法制定可能危及社会公共利益的港口危险货物事故应急预案、重大生产安全事故的旅客紧急疏散和救援预案以及预防自然灾害预案,建立健全港口重大生产安全事故的应急救援体系。
  
  港口发生安全事故或者紧急情况时,港口行政管理部门应当根据事故等级和危害影响程度,启动相应的预案,组织实施应急处置和救援。
  
  第三十一条  港口经营人应当依照有关法律、法规、规章和港口安全作业的规定,加强安全生产管理,建立健全安全生产责任制等制度,完善安全生产条件,采取有效措施,确保安全生产。
  
  港口经营人应当在港口行政管理部门的指导下,依法制定本单位的危险货物事故应急预案、重大生产安全事故的旅客紧急疏散和救援预案以及预防自然灾害预案,报港口行政管理部门备案。
  
  港口发生安全事故或者紧急情况时,港口经营人应当按照预案进行应急处置,防止和控制事故蔓延,并及时报告港口行政管理和安全生产监督管理等部门。
  
  第三十二条  港口经营人应当按照有关规定在码头、仓库、货场、候船厅、停车场等场所配备消防器材和安全检查设施,加强安全检查,及时排除安全隐患。
  
  第三十三条  港口经营人从事危险货物港口作业,应当具备国务院交通主管部门规定的条件,并向所在地港口行政管理部门申请危险货物港口作业资质认定。未取得危险货物港口作业资质的,不得从事危险货物港口作业。
  
  第三十四条  货物或者其他物体落入港口水域可能影响港口安全或者有碍航行的,相关责任人应当立即向港口行政管理部门报告,并负责清除。
  
  港口行政管理部门发现货物或者其他物体落入港口水域的,应当责令相关责任人限期清除;逾期未清除的,可以代为清除;情况紧急的,应当直接予以清除。清除所需费用由相关责任人承担。
  
  第三十五条  遇有旅客滞留、货物积压阻塞港口的情况,港口行政管理部门必须采取有效措施,统一调配港口内运输工具、码头、库场、装卸设备和人员,进行疏港;阻塞港口情况严重的,港口行政管理部门应当及时报告港口所在地人民政府。港口所在地人民政府认为必要时,可以调配社会资源,进行疏港。
  
  第三十六条  港口行政管理部门应当依法履行港口安全监督管理职责,加强对港口安全生产的监督检查,发现安全隐患的,应当责令被检查人立即排除或者限期排除。
  
  被检查单位和有关人员应当接受港口行政管理部门依法实施的监督检查,如实提供有关情况和资料,不得拒绝检查或者隐匿、谎报有关情况和资料。  
  
  第六章  法律责任
  
  第三十七条  违反本办法规定,《中华人民共和国港口法》及其他有关法律、法规已有法律责任规定的,从其规定。
  
  第三十八条  违反本办法第十三条的规定,未经许可,擅自临时使用港口岸线的,由港口行政管理部门责令停止使用,可以处1000元以上5000元以下的罚款。
  
  第三十九条  违反本办法第十五条第一款的规定,擅自改变港口岸线使用范围和使用功能的,由港口行政管理部门责令限期改正,可以处5000元以上2万元以下的罚款。
  
  第四十条  违反本办法第二十五条的规定,为不具备经营资格、超范围经营的船舶提供装卸服务的,由港口行政管理部门责令限期改正,可以处3000元以上1万元以下的罚款。
  
  第四十一条  港口行政管理部门有下列行为之一的,对直接负责的主管人员和其他直接责任人员依法给予处分;构成犯罪的,依法追究刑事责任:
  
  (一)违反规定擅自修改经批准公布的港口规划的;
  
  (二)未按照规定的条件、程序和期限实施行政许可的;
  
  (三)不依法履行监督检查职责,对违反港口规划建设港口、码头或者其他港口设施的行为,未经依法许可从事港口经营的行为,不遵守安全生产管理规定的行为,危及港口作业安全的行为,以及其他违反本办法规定的行为,不依法予以查处的;
  
  (四)其他滥用职权、玩忽职守、循私舞弊的。
  

   第七章  附则
  
  第四十二条  本办法自2008年3月1日起施行。

  Measures of Jiangxi Province for Port Administration
  Chapter 1  General Provisions
  Article 1 In order to strengthen port administration, maintain port safety and operational order, protect the legitimate rights and interests of the parties concerned and promote the construction and development of ports, these measures are enacted in accordance with the Port Law of the People’s Republic of China and other laws and administrative rules and in light of the specific circumstances of the province.
  Article 2 These measures apply to the planning, construction, maintenance, operations and administration of ports and other relevant activities within the administrative area of the province.
  Article 3 The people's government at or above the county level, where the port is situated, shall bring the port construction and development into line with their plans of national economic and social development, protect and make rational use of port recourses in accordance with law.
  Article 4 The province may encourage economic organizations and individuals at home and abroad to invest in port construction and operations in accordance with law, and protects the legitimate rights and interests of the investors.
  Article 5 The provincial competent department of communications shall be in charge of port affairs across the province, and its affiliated port and fairway administrative authorities shall be responsible for the specific port activities across the province.
  The port administrative departments of the city with districts and the county (city or district) shall conduct specific administration of the port under the people’s government at the same level.
  The provincial competent department of communications and port administrative departments of the city with districts and the county (city or district) assigned to conduct specific port administration are hereinafter referred to as port administrative authorities in general.
  Chapter 2  Port Planning
  Article 6 The port plans shall be drawn up in accordance with the requirements of national economy and social development and the needs of national defense, embodying the principle of rational use of coastline resources and complying with the plans for the network of cities and towns, and shall be dovetailed with the general plans for land use, general city plans, river basin plans, flood-control plans, waterway transport development plans, development plans for other modes of transport and other relevant plans provided by laws or administrative rules.
  In drawing up a port plan, specialists shall be invited for expounding and proof. The departments of development and reform, planning, land resources, and water conservancy and the military authorities concerned shall be consulted for suggestions and comments. Its potential impact on the environment shall be appraised in accordance with law.
  Article 7 The port plans include port layout plan and port general plan of the province.
  A port layout plan of the province refers to the plan for geographical distribution of ports across the province, with a clear definition of the level, roles and major functions of each port with the aim of promoting rational use of coastline resources of the ports across the province.
  A port general plan refers to the specific plan of one port in a given period of time, embracing the scope of its water and land areas, the division of the port area, the handling capacity and the types of calling vessels, the character and functions of the port, the use of water and land areas, the use of coastline for construction of port facilities, the allocation of land for construction and the sepuence of construction phases, etc. The port general plan shall conform to the port layout plan of the province.
  Article 8 The compilation of port layout plan of the province shall be organised in accordance with national port layout plan and economic and social development of the province by the provincial people’s government, which shall promulgate it for implementation only after seeking the competent department of communications under the State Council for comments and suggestions as provided in the Port Law of the People’s Republic of China.
  Article 9 If a port has been listed in the directory of national major ports, the compilation of general plan of the port shall be organised by the port administrative authority of the city with districts where the port is situated, and after being examined and approved by the people’s government at the same level, the plan shall be submitted to the provincial people’s government and competent department of communications under the State Council, and after the competent department of communications under the State Council seeks relevant departments and the military authorities concerned for comments and suggestions in accordance with law, the plan shall be promulgated for implementation upon approval by the provincial people’s government jointly with the competent department of communications under the State Council.
  The general plan of a major port decided by the provincial people’s government shall be drawn up by the port administrative authority of the city with districts where the port is situated. After being examined and approved by the people’s government at the same level, the plan shall be submitted to the provincial people’s government, and approved and promulgated for implementation by the provincial people’s government after seeking the competent department of communications under the State Council for comments and suggestions.
  The compilation of general plan of the port other than the ones specified in the preceding two paragraphs shall be organized by the port administrative authority of the county (city or district) where the port is situated, and the plan shall be approved and promulgated for implementation by the people’s government of the county (city or district) where the port is situated after seeking the port administrative department of the province and the city with districts for comments and suggestions. And the plan shall be reported to the provincial people’s government for the record.
  Article 10 No units or individuals shall modify without authorization the port plan which has been approved and promulgated. If the modification is to meet the requirements of economic and social development, it shall be made in accordance with the procedures for formulating the port plan.
  Chapter 3  Port Construction
  Article 11 The port construction shall conform to the port plan. No port facilities shall be constructed at variance with the port plan.
  Article 12 Where the port coastline is to be used for the construction of port facilities, the applicant shall submit a written application to the port administrative authority of the city with districts where the port is situated. However, where the port coastline is to be used for the construction of a project which has been approved by the State Council or the department in charge of comprehensive and macro-economic regulation and control under the State Council, there shall be no need to go through the formalities of examination and approval separately for such use.
  The port administrative authority of the city with districts shall, within 20 days after receipt of the above application, submit its preliminary views out of examination and all the materials for application to the provincial port administrative authority. The provincial port administrative authority shall, within 20 days after receipt of the above submissions from the port administrative authority of the city with districts, make decisions to approve or disapprove the application for the use of port non-deep-water coastline, or submit, on the basis of due examination, its views on the application for the use of port deep-water coastline to the department of communications under the State Council for examination and approval. While examining the application the provincial port administrative authority, shall evaluate the rationality for the use of port coastline and seek the provincial department of development and reform for comments and suggestions.
  Article 13 Where the temporary use of port coastline is needed for the construction of port facilities and handling of cargoes, a written application shall be submitted to the port administrative authority of the city with districts where the port is situated. The port administrative authority of the city with districts shall, within 20 days after receipt of the above application, make decisions to approve or disapprove in accordance with law. Where the port coastline is used temporarily, permanent buildings, structures and facilities shall not be constructed.
  Article 14 The port administrative authority shall issue a certificate for the use of port coastline to the applicant whose application has been approved as qualified for the use or temporary use of port coastline, and if the application has been disapproved, the port administrative authority shall inform the applicant of the disapproval with explanation in written form.
  The period for the use of port coastline shall not exceed 50 years at most. Where the user of port coastline intends to use continuously at the expiration, they shall apply for the extension 60 days before the expiration.
  The period for the temporary use of port coastline shall not exceed one year. Where the user of port coastline intends to use continuously at the expiration, they shall apply for the extension 30 days before the expiration.
  Article 15 The user of port coastline shall use the coastline in accordance with the approved range and purpose, and shall not change the range and purpose of their own accord without authorization.
  Where the port non-deep-water coastline has not started its  construction for two years from the day of obtaining approval, the port administrative authority is entitled to take back the right to the use of port non-deep-water coastline. The taking-back of the right to the use of port deep-water coastline shall be in accordance with the relevant provisions of the state.
  Where the user of port coastline terminates its use of port coastline, they shall go through the formalities for nullifying the use of port coastline in the port administrative authority,
  Article 16 With respect to the port construction project, an application shall be submitted to the competent governmental department of investment for examination and approval or reported for the record in accordance with the relevant regulations of the state and province, and the project shall conform to the relevant national standards and technical specifications.
  The impact as the result of the port construction project on the environment and flood control shall be evaluated in accordance with law. The safety facilities and environmental protection facilities for the port construction project and the principal engineering  of the project shall be designed, constructed and put into use simultaneously.
  With respect to the port construction, the land and water areas shall be used in conformity with the provisions in the laws and administrative rules concerning the administration of land, river courses, fairways and protection for military facilities and other relevant laws and administrative rules.
  Article 17 The port project is subject to the supervision over its constructional safety and quality in accordance with law. The department in charge of the safety supervision over the port construction project shall conduct supervision over the safety of port construction project in accordance with the relevant regulations, and the department in charge of the quality supervision over the port construction project shall conduct supervision over and administration of the quality of port construction project in accordance with the legal procedures and technical specifications.
  Article 18 Upon completion of port construction project, the legal person of the project shall put port facilities into test runs in accordance with the relevant regulations of the state and report them to the port administrative authority for the record prior to the test runs. Where the port facilities are up to the standard for  final acceptance upon completion of test runs, the legal person of the project shall go through the formalities for final acceptance in accordance with the relevant regulations of the state and province, and the port facilities can be put into use only after being checked and accepted as qualified.
  Article 19 The people's governments at or above the county level where the port is situated shall guarantee the necessary investment of funds in the construction and maintenance of port infrastructures for public use, such as fairway and anchorage, and shall take measures and make arrangements for the construction of facilities subsidiary to the port, such as fairway, railway, road, water supply and drainage, power supply and telecommunications.
  The port administrative authority shall strengthen the administration and maintenance of port infrastructures for public use, and make timely readjustment of berth and anchorage within the port area when different circumstances emerge.
  Chapter 4  Port Operation
  Article 20 Whoever intends to operate a port shall meet the operating requirements provided by the laws, administrative rules and regulations, and shall submit a written application to port administrative authority for a port operation permit and register with the administration of industry and commerce in accordance with law.
  The port operations include the operations of wharves and other port facilities, port services for passenger transport, cargo loading, unloading, lightering and storing within the port area, and operations of tugs in port.
  Article 21 Whoever applies to operate a port administered by the people’s government of the city with districts shall submit a written application to the port administrative authority of the city with districts, which shall, within 30 days after receipt of the application, make a decision as to whether to grant or not to grant permission in accordance with law.
  Whoever applies to operate a port administered by the people's governments at or above the county level shall submit a written application to the port administrative authority of the county (city or district) where the port is situated. The port administrative authority of the county (city or district) shall put forward its views out of examination within 10 days after receipt of the application and submit them to the port administrative authority of the city with districts for examination and approval. The port administrative authority of the city with districts shall, within 20 days after receipt of the application, make a decision as to whether to grant or not to grant permission in accordance with law.
  Whoever applies to engage in the international container loading and unloading and roll-on-roll-off transportation of automobiles in the port shall submit a written application to the port administrative authority of the city with districts where the port is situated. The port administrative authority of the city with districts shall put forward its views out of examination within 10 days after receipt of the application and submit them to the provincial port administrative authority for examination and approval. The provincial port administrative authority shall, within 20 days after receipt of the application, make a decision as to whether to grant or not to grant permission in accordance with law.
  Article 22 When granting permission for port operations, the port administrative authority shall follow the principle of openness, impartiality and fairness. If the authority decides to grant permission, it shall issue a Port Operation Permit to the applicant. If it refuses to do so, it shall inform the applicant of the refusal with explanation in written form.
  The period of port operations as permitted shall not exceed the period for the use of coastline.
  Article 23 In conducting operational activities, the port operator shall abide by the relevant laws and administrative rules and the port operating rules, perform the contractual obligations in accordance with law, and provide clients with fair and fine services.
  The port operator engaged in passenger transport shall take effective measures to ensure the passengers’ safety, provide quick and convenient services and keep a good environment for them when they are waiting to board ships.
  The port operator shall, in accordance with the laws, administrative rules and regulations concerning environmental protection, take effective measures against pollution and hazards to the environment.
  Article 24 The port operator shall give first priority to the materials to be used in emergency, the materials for relief of disasters and the materials urgently needed for the buildup of national defense.
  Article 25 The port operator shall not exercise a monopoly of operations or conduct illicit competition, shall not by any means compel others to accept port services they provides and shall not provide loading and unloading services for the ships unqualified for operations or the ships which operate beyond the prescribed range of operations.
  Article 26 The port operator shall abide by the relevant regulations prescribed by the state concerning prices and charges, and at their business place, the port operator shall make public the items of paid services and the service rates, and use the bills prescribed by the state for port operations. Unless made public, no fees shall be collected.
  Article 27 The stipulated fees for the port shall be collected by the port administrative authority entrusted by the financial department, and its items of paid services, the service rates and the measures for administration shall be in accordance with the provisions of the state and province. The port administrative authority shall not increase without authorization the stipulated fee rates or collect the stipulated fees repeatedly.
  Article 28 The port administrative authority shall collect and publish the public information about the port at regular intervals, and shall provide advisory information services for port operators, ship owners, cargo owners and passengers.
  Chapter 5  Port Safety and Supervision
  Article 29 The people's government at or above the county level where the port is situated shall strengthen its leadership of port safety administration, and coordinate the efforts in time to resolve the major problems existing in the port safety management.
  Article 30 The port administrative authority shall, in accordance with law, formulate the port contingency plan against accidents due to dangerous cargoes in ports that may jeopardize public interests, the emergency plan for evacuation and rescue of passengers in a major accident due to lack of safe production and the plan against natural disasters, and it shall also establish a sound port emergency and rescue system against major accidents due to lack of safe production in the port.
  In case of accidents or emergencies in the port, the port administrative authority shall, depending on the severity of the accident and the degree of the danger, activate the relevant contingency plan and organize emergency response operations and rescue work.
  Article 31 The port operator shall, in accordance with the laws, administrative rules and regulations concerning the safe operation of port, tighten its supervision over safe production, establish sound rules and regulations on the responsibility system for safe production, keep improving the conditions for safe production and take effective measures to ensure safe production.
  The port operator shall, under the direction of port administrative authority and in accordance with law, make its own contingency plans against the accidents due to dangerous cargoes, emergency plans for evacuation and rescue of passengers in a major accident due to lack of safe production and plans against natural disasters, and shall report these plans to port administrative authority for the record.
  In case of accidents or emergencies in the port, the port operator shall make immediate responses according to the contingency plan, preventing and controlling the spreading of disasters, and report to the port administrative authority and administration of safe production and supervision in time.
  Article 32
  The port operator shall,in accordance with the relevant provisions equip its wharves,warehouses,freightyards,waiting halls and porting lots, with the fire fighting equipment and safety inspection facilities, strengthen its safety inspection and eliminate in time its hidden dangers.
  Article 33 The port operator engaged in the port operations of dangerous cargoes shall satisfy the essential requirements prescribed by the competent department of communications under the State Council, and shall apply to the port administrative authority in the area where the port is situated for authentication of its qualification for port operations of dangerous cargoes. Whoever is unqualified for the port operations of dangerous cargoes shall not engage in these operations.
  Article 34 In the event that cargoes or other articles fall into water area of the port, which may threaten the port safety or get in the way of navigation, the responsible person shall report the case to the port administrative authority immediately and be held responsible for the elimination of the threat.
  Where the port administrative authority finds that cargoes or other articles have fallen into water area of the port, it shall order the responsible person to eliminate them within a prescribed time-limit, and if no elimination is done within the prescribed time-limit, it shall eliminate just on behalf of the person liable, or eliminate of its own accord under the emergency circumstances, but the expenses thus caused shall be borne by the person liable.
  Article 35 In case passengers and cargoes are held up so that the port is blocked, the port administrative authority shall take effective measures to mobilize on a unified basis the means of transport inside the port, the wharves, the warehouses or freight yards, the handling facilities and staff for the purpose of dispersal of  passengers and cargoes. In case the port is seriously blocked, the port administrative authority shall report it promptly to the people’s government in the area where the port is situated. The people’s government in the area where the port is situated is entitled to mobilize, if necessary, the social resources for the purpose of dispersal of passengers and cargoes.
  Article 36 The port administrative authority shall, in accordance with law, perform the duties of port safety supervision and management and strengthen the supervision over and inspection of safe production in the port. If hidden dangers to safety are found during inspection, it shall order the inspected party to eliminate such dangers immediately or within a prescribed time-limit.
  The unit to be inspected and individuals concerned shall accept the supervision and inspection conducted by the port administrative authority in accordance with law, truthfully provide the related information and materials, and shall not refuse to accept inspection or conceal the related information and materials or provide false information and materials.
  Chapter 6  Legal Responsibilities
  Article 37
  Where the legal responsibilities for the violation of these measures have been defined in the Port Law of the People’s Republic of China and other relevant laws and administrative rules, the relevant provisions in the laws and rules mentioned above shall prevail.
  Article 38 Whoever violates the provisions in Article 13 of these measures and uses the port coastline without obtaining approval shall be ordered by the port administrative authority to stop using the coastline and a fine of more than RMB 1,000 yuan but less than RMB 5,000 yuan can be imposed.
  Article 39 Whoever violates the provisions in the first paragraph of Article 15 of these measures by changing without authorization the range   and the purpose in using port coastline shall be ordered by the port administrative authority to rectify the violation within a prescribed time-limit, and a fine of more than RMB 5,000 yuan but less than RMB 20,000 yuan can be imposed.
  Article 40 Whoever violates the provisions in Article 25 of these measures by providing loading and unloading services for the ships unqualified for operations or ships operating beyond the prescribed range shall be ordered by the port administrative authority to rectify within a prescribed time-limit, and a fine of more than RMB 3,000 yuan but less than RMB 10,000 yuan can be imposed.
  Article 41 Where the port administrative authority commits one of the following acts, the executive directly in charge and other directly responsible persons shall be given administrative sanctions in accordance with law. And if a crime is constituted, The committing party shall be investigated for criminal liability.
  (1) Violating the provisions by changing the approved and promulgated port plan without authorization;
  (2) Granting the administrative permission not in accordance with the prescribed requirements, procedures and time-limit;
  (3) Failing to perform the duties of supervision and inspection decided by law and making no investigation into or imposing no punishment on the acts of constructing the port, wharf or other port facilities in violation of the port plan, engaging in the port operations without lawful permission, failing to abide by the rules concerning the safe production and management, endangering the port operating safety and other acts of violating these measures;
  (4) Other acts of abusing one’s power, neglecting one’s duties, and committing irregularities.
  Chapter 7  Supplementary Provisions
  Article 42 These measures shall come into effect as of March 1, 2008.
