江西省实施《地方志工作条例》办法(附:英文译本)

  《江西省实施〈地方志工作条例〉办法》已经2008年1月11日省人民政府第69次常务会议审议通过,现予公布,自2008年3月1日起施行。

  江西省实施《地方志工作条例》办法  
  
  第一条  为了规范本省地方志编纂工作,科学、合理地开发利用地方志,发挥地方志在促进经济社会发展中的作用,根据国务院《地方志工作条例》,结合本省实际,制定本办法。
  
  第二条  本办法适用于本省行政区域内地方志的组织编纂、管理、开发利用等活动。
  
  第三条  本办法所称地方志,包括地方志书、地方综合年鉴。
  
  地方志书,是指全面系统地记述本行政区域自然、政治、经济、文化和社会的历史与现状的资料性文献。
  
  地方综合年鉴,是指系统记述本行政区域自然、政治、经济、文化和社会等方面情况的年度资料性文献。
  
  地方志分为:省编纂的地方志,设区市编纂的地方志,县(市、区)编纂的地方志。其中省编纂的地方志书由各分志组成。
  
  第四条  县级以上人民政府应当加强对本行政区域地方志工作的领导,将地方志工作纳入国民经济和社会发展规划。地方志工作所需经费列入本级财政预算。
  
  第五条  县级以上人民政府负责地方志工作的机构(以下简称地方志工作机构)在本级人民政府和地方志编纂委员会的领导下,主管本行政区域的地方志工作,履行下列职责:
  
  (一)组织、指导、督促和检查地方志工作;
  
  (二)拟定地方志工作规划和编纂方案;
  
  (三)组织编纂地方志书、地方综合年鉴;
  
  (四)搜集、保存地方志文献和资料,组织整理旧志;
  
  (五)推动地方志理论研究与宣传工作,培训地方志编纂人员;
  
  (六)组织开发利用地方志资源。
  
  第六条  编纂地方志应当做到存真求实,确保质量,全面、客观地记述本行政区域自然、政治、经济、文化和社会的历史与现状。
  
  第七条  县级以上行政区域的地方志工作规划(以下简称规划)和编纂方案(以下简称方案),由本级地方志工作机构拟定、本级地方志编纂委员会审定,经本级人民政府批准后实施,并报上一级地方志工作机构备案。
  
  第八条  以县级以上行政区域名称冠名的地方志书、地方综合年鉴,分别由本级地方志工作机构按照规划和方案组织编纂,其他组织和个人不得编纂。
  
  地方志书每20年左右编修一次;地方综合年鉴按年度编纂。
  
  第九条  编纂地方志应当吸收有关方面的专家、学者参加。地方志编纂人员实行专兼职相结合,专职编纂人员应当具备相应的专业知识。
  
  地方志编纂人员应当恪尽职守、客观公正,据事直书、忠于史实。任何单位和个人不得要求编纂人员在地方志中作虚假记述。
  
  第十条  地方志工作机构应当建立征集制度,及时征集和保存文字、图表、照片、音像、电子文本、实物等各种地方志资料。
  
  地方志工作机构可以采用查阅、摘抄、复制等形式,向机关、社会团体、企业事业单位、其他组织以及个人征集有关地方志资料,有关单位和个人应当提供支持。但涉及国家秘密、商业秘密和个人隐私以及不符合档案开放条件的除外。
  
  第十一条  根据规划和方案规定承担地方志编纂任务的有关机关、社会团体、企业事业单位以及其他社会组织(以下简称承编单位),应当确定编纂机构或者人员,并在本级地方志工作机构指导下,按照方案规定的时间和质量要求完成编纂任务。
  
  承编单位的编纂任务完成后,由规划和方案确定的总纂单位负责总纂,形成初审稿。
  
  第十二条  对以县级以上行政区域名称冠名、列入规划的地方志书实行初审、复审、验收制度。未经审查验收,地方志书不得公开出版。
  
  第十三条  地方志书的初审会由总纂单位主持。
  
  初审会应当组织有关保密、档案、历史、法律、经济、军事等方面的专家参加,重点审查地方志书初审稿的内容是否符合宪法和保密、档案等法律、法规的规定,是否全面、客观地反映本行政区域自然、政治、经济、文化和社会的历史与现状。
  
  总纂单位应当根据初审意见对地方志书初审稿进行修改,形成复审稿后提请复审。
  
  第十四条  省编纂的地方志书各分志的复审会由省地方志工作机构主持,设区市、县(市、区)编纂的地方志书的复审会由上一级地方志工作机构主持。
  
  复审会应当组织地方志等方面的有关专业人员参加,对地方志书复审稿进行审查。
  
  总纂单位应当根据复审意见对地方志书复审稿进行修改,形成验收稿后提请验收。
  
  第十五条  地方志书的验收会由本级地方志编纂委员会主持,地方志等方面的有关专业人员参加,对地方志书验收稿进行验收。
  
  地方志书经验收合格后,方可以公开出版。
  
  第十六条  以县级以上行政区域名称冠名的地方综合年鉴,由负责组织编纂的地方志工作机构报本级地方志编纂委员会审定,并经本级人民政府批准,方可以公开出版。
  
  第十七条  地方志出版后,负责组织编纂的地方志工作机构应当在3个月内报送上级地方志工作机构备案,并向上级方志馆或者地情资料库报送地方志藏本。
  
  在地方志编纂过程中收集到的文字资料、图表、照片、音像资料、实物等以及形成的地方志文稿,由本级地方志工作机构指定专职人员集中统一管理,妥善保存,不得损毁;修志工作完成后,应当依法移交本级国家档案馆或者方志馆保存、管理,个人不得据为己有或者出租、出让、转借。
  
  第十八条  地方志工作机构应当积极开拓社会用志途径,可以通过建设方志馆、地情资料库、网站等方式,加强地方志工作的信息化建设,为经济社会的全面发展服务。
  
  第十九条  公民、法人和其他组织可以通过查阅、摘抄等方式利用方志馆或者地情资料库收藏、展示的地方志文献和资料。
  
  方志馆、地情资料库应当将服务范围、开放时间等服务事项进行公示。
  
  鼓励单位和个人向方志馆、地情资料库捐赠或者有偿提供地方志文献和资料。
  
  第二十条  违反本办法,国务院《地方志工作条例》已有法律责任规定的,从其规定。
  
  第二十一条  违反本办法规定,有关单位或者个人要求地方志编纂人员在地方志中作虚假记述的,由上一级地方志工作机构提请本级人民政府予以通报批评,追究相关责任人的责任。
  
  违反本办法规定,地方志编纂人员在地方志中作虚假记述的,由地方志工作机构依法给予处分。
  
  第二十二条  违反本办法规定,承编单位拒绝承担编纂任务,或者不按照规定的时间和质量要求完成编纂任务的,由地方志工作机构督促其限期改正;逾期不改正的,由地方志工作机构提请本级人民政府责令其采取相应措施予以纠正,并可予以通报批评,追究相关责任人的责任。
  
  第二十三条  需要编纂部门志、行业志、乡(镇)志且已具备编纂条件的,其编纂工作参照本办法的相关规定执行。
  
  第二十四条  本办法自2008年3月1日起施行。

  Decree No.162 of the People’s Government of Jiangxi Province
  Measures of Jiangxi Province to Implement the Regulations on the Work of Local Chronicles (hereinafter referred to as these Measures), adopted at the 69th Executive Meeting of the People’s Government of Jiangxi Province on January 11, 2008, are hereby promulgated, and shall come into effect as of March 1, 2008.

   Measures of Jiangxi Province to Implement the Regulations on the Work of Local Chronicles
   Article 1 These Measures are formulated on the basis of the Regulations of the State Council on the Work of Local Chronicles and the practical situations of the province in order to standardize the compilation of local chronicles of the province, develop and utilize local chronicles in a scientific and reasonable manner, giving full play to the functions of the local chronicles in promoting the economic and social development.
   Article 2 These Measures apply to the compilation, administration, development and utilization of local chronicles within the administrative areas of the province.
   Article 3 The term “local chronicles” as mentioned in these Measures refers to local chronicles and comprehensive local yearbooks.
   The term “local chronicles” refers to the materials and literature that describe the history and status quo of the administrative areas of the province regarding nature, politics, economy, culture and society in a comprehensive and systematic manner.
   The term “comprehensive local yearbooks” refers to yearly literature that records the history and status quo of the administrative areas regarding nature, politics, economy, culture and society in a systematic manner.
   The local chronicles are classified into three categories: local chronicles as compiled by the province, local chronicles as compiled by the districted city, and local chronicles as compiled by the county (non-districted city or district subordinate to a city). Among them, the chronicles compiled by the province are comprised of the sub-chronicles.
   Article 4 The People’s Government at or above the county level shall intensify the leadership of local chronicles within its administrative area. The work of local chronicles shall be incorporated into the plan for national economic and social development, and the expenses thus required shall be incorporated into the financial budget at the same level.
   Article 5 The organs of the people’s government at or above the county level in charge of local chronicles (hereinafter referred to as the organs in charge of local chronicles) shall, under the leadership of the people’s government at the same level and the committee for compilation of local chronicles, take charge of local chronicles within its administrative area and perform the following functions and duties:
   (1) Organizing, guiding, supervising and examining the work of local chronicles;
   (2) Drafting a work program for local chronicles and a plan of compilation;
   (3) Organizing the compilation of local chronicles and comprehensive local yearbooks;
   (4) Collecting and preserving the literature and materials of local chronicles, organizing the sorting of old local chronicles;
   (5) Promoting the theoretical research and publicity of local chronicles; and training compilers for local chronicles;
   (6) Organizing the development and utilization of local chronicle resources.
   Article 6 The compilation of local chronicles shall be authentic and truthful so as to guarantee the quality thereof and fully and objectively describe the history and status quo of an administrative area regarding the nature, politics, economy, culture and society.
   Article 7 Work programs for local chronicles of administrative areas at or above the county level (hereinafter referred to as the programs) and plans of compilation (hereinafter referred to as the plans) shall be formulated by the organ in charge of local chronicles at the same level, reviewed by the committee for compilation of local chronicles at the same level, executed upon the approval from the people’s government at the same level, and reported to the immediate superior organ in charge of local chronicles books for the record.
   Article 8 As to any local chronicle bookss or local comprehensive yearbooks that have their book titles preceded by the name of its administrative area at or above the county level, their compilation thereof shall be organized by the organ of the people’s government at the same level in charge of local chronicles. No other organization or individual may conduct the relevant compilation.
   The local chronicles are compiled and revised every two decades, and the local comprehensive yearbooks are compiled annually.
   Article 9 Relevant experts and scholars shoud be invited to the compilation of local chronicles  either as full-time or part-time compilers of local chronicles. Full-time compilers shall have the corresponding professional knowledge.
   The compilers of local chronicles shall perform their duties scrupulously abiding by the principle of objectivity and fairness, recording happenings truthfully and keeping faithful record of the historical facts. No unit or individual shall solicet the compilers to make false records in the local chronicles.
   Article 10 The organ in charge of local chronicles shall establish collection system so as to promptly  collect and keep chronicle materials in various forms, including written materials, graphs, pictures, audio-visuals, electronic texts, and material objects.
   The organ in charge of local chronicles may collect the relevant materials of local chronicles from the relevant organs, social associations, enterprises and public institutions, other organizations as well as individuals. The relevant entities and individuals shall provide support. The organ in charge of local chronicles may consult, make excerpts of or photocopy the relevant materials, unless any state secrets, commercial secrets or individual privacy is involved, or the materials that fail to meet the requirements for archives publication.
   Article 11 Relevant organs, social associations, enterprises and public institutions, and other social organizations shouldering the task of compiling local chronicles (hereinafter referred to as the compiling units)provided in the programs or the plans shall determine the compiling organs or staff, who shall, under the guidance of the organ in charge of local chronicles at the same level, have the task of compilation accomplished in terms of time and quality prescribed in the programs or the plans.
   After the compiling units have completed the compilation, the general compiling unit identified in the programs or the plans shall take charge of the general compilation and produce the first draft for preliminary examination.
   Article 12 A system of preliminary examination, review and acceptance applies to local chronicles (listed in the program) that have their titles preceded by the name of its administrative area at or above the county level. Without the examination and acceptance, No local chronicle shall be published openly.
   Article 13 The preliminary examination meeting of the local chronicles shall be presided over by the general compiling unit.
   Experts in confidentiality, archives, history, law, economy and military and others shall be invited to the meeting,and their main work is to check whether the contents of the first draft conform to the Provisions of the Constitution and the Laws and Regulations on Confidentiality, Archives and others, and whether they fully and objectively reflect the history and status quo of an administrative area regarding nature, politics, economy, culture and society.
   The general compiling unit shall make amendments to the first draft according to the opinions from the preliminary examination, and propose the second draft for review.
   Article 14 The review meeting of the sub-chronicles of the local chronicles complied by the province shall be presided over by the provincial organ in charge of local chronicles, and the review meeting of local chronicles compiled by the districted city or county (non-districted city or district subordinate to a city) shall be presided over by the immediate sceperior organ in charge of the work on local chronicles.
   Professionals in local chronicles shall be invited to the review meeting and to review the drafts of the revised copy of local chronicles.
   The general compiling unit shall make amendments to the second draft of local chronicles in accordance with the opinions from the meeting . Having compiled the final draft for acceptance, the unit shall propose it for acceptance.
   Article 15 The meeting for the acceptance of local chronicles is presided over by the committee for compilation of local chronicles at the same level, and relevant professionals in local chronicles are to participate in the acceptance of the final copy of the local chronicles.
   Local chronicles are allowed for open publication only after their acceptance.
   Article 16 Prior to open publication, comprehensive local yearbooks whose titles are preceded by the name of the administrative area at or above county level shall be reported by the local organ in charge of organization and compilation of local chronicles to the committee for compilation of local chronicles at the same level for examination and to the people’s government at the same level for approval.
   Article 17 After the local chronicles have been published, the organ in charge of organization and compilation of local chronicles shall, within 3 months thereafter, submit these chronicles to the immediate superior organ in charge of local chronicles for file, and send copies of these chronicles to the superior local chronicles library or geographical information database for collection.
   Written materials, graphs, pictures, audio-visual materials, actual objects and manuscripts of the finished local chronicles gathered during the compilation of the local chronicles shall be subject to centralized and unified management and proper preservation by professionals assigned by the organ for local chronicles at the same level and shall not be destroyed; the finished local chronicles shall be transferred to local national archives or local chronicles library for preservation and maintenance, and no individual shall possess, rent, transfer, or lend them .
   Article 18 Organs in charge of local chronicles shall actively explore the channels for the society to use the local chronicles in an effort to promote the informationization of the work of local chronicle to serve the all-round development of the economic society through the establishment of local chronicles libraries, geographical information databases, and websites.
   Article 19 Citizens, legal persons and other organizations can utilize local chronicles literature and materials collected and exhibited in the local chronicles libraries or geographical information databases through consultation or excerption of them.
   Local chronicles libraries and geographical information database shall publicize their service coverage, open hours and other service items.
   Units and individuals are encouraged to donate or non-gratuitously provide local chronicle literature and materials to the local chronicles libraries and geographical information databases.
   Article 20 As to any violation of these Measures, if legal liabilities for such violation have been provided in the Regulations of the State Council on the Work of Local Chronicles, then these Regulation shall be followed.
   Article 21 As to the violation of these Measures by relevant organs or individuals who have required the compilers of local chronicles to make false records, the immediate superior organ in charge of local chronicles shall request the people’s government at the same level to cirulate a notice of criticism and investigate the responsibilities of responsible persons concerned.
   As to the violation of these Measures by the compilers of the local chronicles who have made false records in the local chronicles, they are subject to sanctions imposed by the organ in charge of local chronicles in accordance with the law.
   Article 22 As to the violation of these Measures by the compiling units who have refused to undertake the task of compilation or have failed to complete the compilation as per the time and quality required, the organ in charge of local chronicles will urge them to make rectification within a time limit; in case of failure to make rectification after the time limit, the organ shall request the people’s government at the same level to order them to take corresponding measures for correction, circulate a notice of cicticism, and investigate responsibilities of responsible persons concerned.
   Article 23 As to the chronicles of departments, industry and township (towns) which need to be compiled and are ready for the compilation, the relevant provisions of these Measures are applicable to the compilation of above mentioned chronicles.
   Article 24 These Measures take effect as of March 1, 2008.
