江西省行政区域界线管理办法(附:英文译本)

  《江西省行政区域界线管理办法》已经2008年1月11日省人民政府第69次常务会议审议通过,现予公布,自2008年3月1日起施行。

                江西省行政区域界线管理办法 
  
  第一条  为了加强行政区域界线管理,保障行政区域界线附近地区正常的生产生活秩序,维护社会和谐稳定,根据国务院《行政区域界线管理条例》,结合本省实际,制定本办法。
  
  第二条  本办法所称行政区域界线,是指国务院或者省人民政府批准的行政区域毗邻的各有关人民政府行使行政区域管辖权的分界线。
  
  各级人民政府必须严格执行行政区域界线批准文件和行政区域界线协议书的各项规定,维护行政区域界线的严肃性、稳定性。
  
  第三条  省人民政府民政部门负责全省行政区域界线管理工作。设区市、县(市、区)人民政府民政部门负责本行政区域界线管理工作。
  
  发展改革、国土资源、水利、农业、林业、建设、规划等部门应当按照各自职责,做好行政区域界线管理的相关工作。
  
  第四条  行政区域界线勘定后,毗邻的有关人民政府应当签订行政区域界线协议书(含附图,下同),并报省人民政府批准。
  
  行政区域界线协议书经批准后,具有法律效力,应当作为处理行政区域界线争议的依据。
  
  第五条  本省与毗邻省的行政区域界线,依照国务院《行政区域界线管理条例》的有关规定公布。本省范围内的县级行政区域界线,由省人民政府予以公布。
  
  第六条  行政区域界线的管理实行分级负责制:
  
  (一)本省与毗邻省的行政区域界线由省人民政府依照国务院《行政区域界线管理条例》的有关规定管理,省人民政府民政部门负责日常工作;
  
  (二)本省范围内设区市之间的县级行政区域界线,由毗邻的设区市人民政府共同管理,设区市人民政府民政部门负责日常工作;
  
  (三)设区市范围内的县级行政区域界线,由毗邻的县(市、区)人民政府共同管理,县(市、区)人民政府民政部门负责日常工作。
  
  第七条  行政区域界线的实地位置,以界桩以及作为行政区域界线标志的河流、沟渠、堤坝、山脊、道路等线状地物和行政区域界线协议书中明确规定作为指示行政区域界线走向的其他标志物标定。
  
  第八条  行政区域界线界桩由行政区域界线毗邻的各有关人民政府共同设立,单方设立的无效。
  
  任何组织或者个人不得擅自移动或者损坏界桩。
  
  第九条  行政区域界线毗邻的各有关人民政府应当按照行政区域界线协议书的规定,对界桩进行分工管理。对轻度损坏可以修复的界桩,由分工管理该界桩的一方在毗邻方在场的情况下修复,并刷新界桩上的注记;界桩丢失或者严重损坏不能修复的,由分工管理该界桩的一方重新制作,并与毗邻方共同按照界桩登记表和界桩成果表记载的界桩位置,在原地重新埋设。
  
  第十条  因建设、开发等原因需要移动或者增设界桩的,行政区域界线毗邻的各有关人民政府应当协商一致,在原界桩附近行政区域界线上选定适当位置重新埋设或者增设,共同测绘,制作界桩登记表和界桩成果表,增补相关档案资料,并报省人民政府备案。
  
  第十一条  界桩因自然原因损坏或者受到人为破坏但无法查明破坏行为实施者的,其修复、增设所需费用由分工管理该界桩的一方承担;因建设、开发等原因需要修复或者增设的,其修复、增设所需费用由建设、开发单位或者个人承担。
  
  第十二条  行政区域界线毗邻的任何一方不得擅自改变作为行政区域界线标志的河流、沟渠、堤坝、山脊、道路等线状地物;因自然原因或者其他原因改变的,毗邻的各有关人民政府应当在保持行政区域界线协议书划定的界线位置不变的前提下,共同协商,确定新的标志物。行政区域界线协议书中另有约定的除外。
  
  第十三条  行政区域界线协议书中明确规定作为指示行政区域界线走向的其他标志物,应当维持原貌并加以保护。因自然原因或者其他原因使标志物发生变化的,负责分工管理的县级以上人民政府民政部门应当及时通知毗邻方,共同协商,组织修测,确定新的标志物,并报省人民政府备案。
  
  第十四条  行政区域界线毗邻的各有关人民政府应当保护行政区域界线两侧的地形、地貌。行政区域界线两侧地形、地貌的保护范围由毗邻的各有关人民政府协商确定。
  
  生产、建设用地在保护范围内,需要横跨行政区域界线的,应当事先征得毗邻的各有关人民政府同意,分别办理审批手续,并报省人民政府备案。
  
  第十五条  未经国务院或者省人民政府批准,任何组织或者个人不得擅自变更行政区域界线;确需变更的,应当依照《国务院关于行政区划管理的规定》办理审批手续;经批准变更的,毗邻的各有关人民政府应当按照勘界测绘技术规范进行测绘,埋设界桩,签订协议书,并将协议书报批准变更该行政区域界线的机关备案。
  
  第十六条  行政区域界线毗邻的县级以上人民政府应当依照国务院《行政区域界线管理条例》的有关规定,建立行政区域界线联合检查制度,组织开展行政区域界线联合检查,消除行政区域界线纠纷隐患,维护界线附近地区稳定。
  
  行政区域界线联合检查每五年进行一次。遇有影响行政区域界线实地走向的自然灾害、河流改道、道路变化等特殊情况,由行政区域界线毗邻的各有关人民政府共同对行政区域界线的特定地段随时安排联合检查。
  
  第十七条  本省与毗邻省的行政区域界线的联合检查,依照国务院民政部门《省级行政区域界线联合检查实施办法》的有关规定执行。
  
  本省范围内县级行政区域界线的联合检查,由省人民政府民政部门统一部署。设区市之间的县级行政区域界线联合检查,由毗邻的设区市人民政府民政部门联合组织实施;设区市范围内的县级行政区域界线联合检查,由毗邻的县(市、区)人民政府民政部门联合组织实施。
  
  第十八条  对联合检查中发现的行政区域界线标志物损坏、丢失或者发生变化等问题,实施联合检查的民政部门应当协商解决,或者依法提请上一级人民政府处理;对联合检查中发现的未经毗邻的有关人民政府同意并依法办理审批手续,越界从事生产建设活动等问题,实施联合检查的民政部门应当及时报告上一级人民政府。接到报告的人民政府应当责成有关部门依法予以处理。
  
  联合检查工作完成后,实施联合检查的民政部门应当共同形成联合检查报告,并通过毗邻的有关人民政府共同报送省人民政府备案。
  
  第十九条  勘定行政区域界线以及行政区域界线管理中形成的协议书、工作图、界线标志记录、备案材料、批准文件以及其他与勘界记录有关的材料,县级以上人民政府民政部门应当按照有关档案管理的法律、法规的规定收集整理、立卷归档,妥善保管。
  
  省人民政府民政部门应当建立和完善行政区域界线信息管理系统,建立与行政区域界线有关的地图图库及文字资料数据库,为政府和社会提供行政区域界线成果信息化服务。
  
  第二十条  因对本省与毗邻省的行政区域界线实地位置认定不一致引发的争议,依照国家有关规定处理。
  
  因对本省范围内行政区域界线实地位置认定不一致引发的争议,由毗邻的各有关人民政府协商解决;经协商未达成协议的,由省人民政府民政部门协调解决;经协调后仍无法达成一致意见的,由省人民政府民政部门提请省人民政府处理。
  
  第二十一条  违反本办法规定,国家机关工作人员在行政区域界线管理中有下列行为之一的,根据不同情节,依法给予处分;致使公共财产、国家和人民利益遭受重大损失,构成犯罪的,依法追究刑事责任:
  
  (一)不履行行政区域界线批准文件和行政区域界线协议书规定的义务,或者不执行行政区域界线的批准机关的决定的;
  
  (二)擅自移动、改变行政区域界线标志,或者命令、指使他人擅自移动、改变行政区域界线标志,或者发现他人擅自移动、改变行政区域界线标志不予制止的;
  
  (三)毗邻方未在场时,擅自设立、维修行政区域界线标志的。
  
  第二十二条  违反本办法规定,故意损毁或者擅自移动界桩或者其他行政区域界线标志物的,应当支付修复标志物的费用,并由所在地负责管理该行政区域界线标志的人民政府民政部门处200元以上1000元以下的罚款;构成违反治安管理行为的,并依法给予治安管理处罚。
  
  第二十三条  乡、民族乡、镇行政区域界线的管理,参照本办法的有关规定执行。
  
  第二十四条  本办法自2008年3月1日起施行。

Measures on the Administration of Administrative
     Boundaries of Jiangxi Province
  
  Article 1. In order to strengthen the administration of administrative boundaries, ensure the normal production and living around the administrative boundaries, and defend the social harmony and stability, the provincial government ,acting in accordance with the Regulations of the State Council on Administration of Administrative Boundaries, and integrating our provincial reality ,formaulated these measures.
  Article 2. For the purpose of these measures, administrative boundaries refer to the boundaries approved by the State Council or the People’s Governments of provinces, within which the relevant people’s governments whose administrative areas are adjacent to each other exercise their respective jurisdiction.
   The people’s governments at various levels shall strictly implement the provisions of the approval documents and the agreements on administrative boundaries ,and uphold the solemnity and stability of administrative boundaries.
  Article 3. The Civil affairs department of the provincial people’s government shall be responsible for the administration of administrative boundaries throughout the province .The civil affairs drpartments of the cities divided into districts or counties (cities, districts) shall be responsible for the administration of administrative boundaries of their respective administrative areas .
  Development and reform,land and resources ,water resources ,agriculture ,forestry, construction,planning and other drpartments shall effectively undertake the relevant work on administration of administrative boundaries of their respective administrative areas.
  Article 4. After being demarcated administrative boundaries, relevant people’s governments whose administrative boundaries are adjacent to each other ,shall sign the agreements on administrative boundaries (including the maps), and submit to the provincial people’s government for approval.
  After approval the agreement on administrative boundaries shall be effective and be abided by in setting disputes on the administrative boundaries.
  Article 5. The administrative boundaries between this province and the adjacent provinces shall be published in accordance with the relevant provisions of the Regulations of the State Council on Administration of Administrative Boundaries.The administrative boundaries at county level within this province shall be published by provincial people’s government.
  Article 6. The administration of administrative boundaries shall be  managed by different levels.
  (1) The administrative boundaries between this province and the adjacent provinces shall be managed by the provincial people’s government in accordance with the relevant provisions of the Regulations of the State Council on Administration of Administrative Boundaries ,and the civil affairs department of provincial people’s government shall take up the routine work .
  (2) The administrative boundaries at the county level between the cities divided into districts within this province shall be jointly managed by the people’s governments of the adjacent cities divided into districts ,and the civil affairs departments of the people’s governments of the cities divided into distincts shall take up the routine work.
  (3) The administrative boundaries at the county level within the cities divided into districts shall be jointly managed by the people’s governments of the adjacent counties ,(cities and districts,) and the civil affairs departments of the people’s governments of the counties (cities and districts) shall take up the routine work.
  Article 7 The actual location of administrative boundaries shall be marked by boundary stakes and line-shaped terrains,such as rivers,fosses,dikes, mountain ridges or roads that are used as administrative boundary markers or other markers indicating the alignment of the administrative boundaries that are explicitly specified in the agreements on administrative boundaries.
  Article 8 The boundary stakes of the administrative boundaries shall be jointly erected by the relevant people’s governments whose administrative boundaries are adjacent to each other, and one-sided erection shall be invalid.
  No organization or individual may, without authorization ,move or damage boundary stakes.
  Article 9 The relevant people’s governments whose administrative boundaries are adjacent to each other shall, in accordance with the provisions of the agreement on administrative boundaries, carry out the administration of the boundary stakes on the basis of work division.The slightly damaged boundary stakes, which can be repaired,shall be repaired and the sign of boundary stakes shall be refurbished by the party who administers them in the presence of the adjacent party concerned.Where the boundary stakes have been lost or severely damaged ,the party who administers the boundary stakes shall remake the boundary stakes and ,together with adjacent party according to the location of boundary stakes ,which have been recorded by the registration form and achivrement form of the boundary stakes, erect the new boundary stakes in the original place.
  Article 10 Where there is a need to move or erect new boundary stakes due to construcution, development or other reason,the relevant people’s governments whose administrative boundaries are adjacent to each other shall reach an agreement on this issue through consulation ,choice the proper place near original boundary stakes on administration of Administrative boundaries, move or erect new boundary stakes, jointly carry out the surveying and mapping ,make the registration form and achievement form of the boundaries stakes ,supplement the relevant data to the archives, and submit a relevant report to the provincial people’s government for the record.
  Article 11 When the boundary stakes are damaged due to natural force or backstage manipulator with ulterior trick who cannot be found by the relevant department for a short time ,the expenses of repairing the damaged boundary stakes or erecting new boundary stakes shall be paid by the party of administration of the boundary stakes on the basis of work division .Where there is a need to repair or erect new boundary stakes due to construction or development or other reason ,the units of construction or development or indiriduals shall pay off the expenses.
  Article 12 Neither of the parties whose administrative boundaries are adjacent to each other may change the line-shaped terrains such as rivers , fosses, dikes, ridge or roads that are used as administrative boundary markers without authorization ;where the line-shaped terrains are changed due to natural forces or other reasons ,the relevant people’s governments whose administrative boundaries are adjacent to each other shall first keep the administrative boundaries concerned in their original location as defined in the agreement on such administrative boundaries,consult together ,and decide the new markers, except as otherwise stipulated in the agreement on administrative boundaries.
  Article 13 Other markers that are explicitly designated in the agreement on administrative boundaries to indicate the alignment of administrative boundaries shall be kept in their original state and protected . Where such markers are changed due to natural force or other reasons, the civil affairs departments of the people’s governments at or above the county level ,which are resposible for the administration of administrative boundeeries on the basis of work division ,shall timely notify the adjacent party ,jointly consult about the matter ,organize the resurvey, designate new markers ,and submit to the provincial people’s government for the record.
  Article 14. The relevant people’s governments whose administrative boundaries are adjacent to each other shall protect the terrain and landform on both sides of the administrative boundaries ,and the protection’s scope of the terrain and landforms on both sides shall be confirmed by the relevant adjacent people’s governments through consultation.
  Where the land for production and construction within the scope of protection stretches over the administrative boundary, the consent of the relevant adjacent people’s governments shall be obtained beforehand ,formalities for examination and approval shall be completed respectively ,and such matter shall be reported to the provincial people’s government for the record.
  Article 15. No organization or individual may change administrative boundaries without approval of the State Council or the provincial people’s government ;where there is a need to change the administrative boundaries ,the relevant party shall act in accordance with the Provisions of the State Council on Administration of Administrative Division and complete formalities for examination and approval; where a change is approved ,the relevant people’s governments whose administrative boundaries are adjacent to each other shall carry out the surveying and mapping therefor in accordance with the technical procedures of surveying and mapping ,erect new boundaries stakes ,conclude an agreement thereon and submit the agreement concluded to the organ that approved such administrative boundaries for the record.
  Article 16. The people’s governments at or above county level that have common administrative boundaries shall, in accordance with the relevant provisions of Regulations of the State Council on Administration of Administrative boundaries ,establish a system of joint inspection over administrative boundaries ,organize and carry out joint inspection ,eradicate trouble and maintain the stability in areas along administrative boundaries.
  A joint inspection shall be implemented every five years. In case of special circumstances such as natural disaster ,change of river course ,or change of road which influence the alignment of the administrative boundaries ,the relevant people’s governments that have common administrative boundaries shall ,whenever necessary ,carry out joint inspection over the relevant part of such administrative boundaries.
  Article 17. The joint inspection over the administrative boundaries between this province and the adjacent provinces shall be implemented according to the relevant provisions on the Measures of Joint Inspection over Administrative Boundaries at Provincial Level of the civil affairs department of the State Council.
  The joint inspection over the administrative boundaries at county level within this  province shall be overall arranged by the civil affairs department of the provincial people’s government . The joint inspection over the administrative boundaries at county level between the cities divided into districts shall be jointly organized and implemented by the civil affairs departments of the people’s governments of adjacent cities divided into districts; the joint inspection over the county administrative boundaries within cities divided into districts shall be jointly organized and implemented by the civil affairs departments of the adjacent counties (cities and districts )people’s governments.
  Article 18. Where the administrative boundary markers are damaged ,lost or changed and so forth ,the civil affairs department which implements the joint inspection , shall settle those problems through cousultation ,or submit settlement to the upper people’s government according to law. Where it occurs in the joint inspection that the administrative boundary is stretched due to production, construction or other activities ,which are not agreed upon by the adjacent people’s government and the formalities for examination and approval are also not completed according to law.Thus the civil affairs department shall timely report to the higher people’s government ,and the people’s government shall order the relevant department to handle it in accordance with the law.
  When the joint inspection is finished ,the civil affairs department which carries out the joint inspection over administrative boundaries shall write a report  of  joint inspection, and through the adjacent and relevant people’s governments jointly submit the report to the provincial people’s government for record.
   Article 19. The agreement, work maps , records of boundary markers, materials for the record, approval documents and other materials concerning the demarcation records that are produced in demarcation and administration of administrative boundaries shall be collected and put in order ,filed and properly preserved in accordance with the relevant law and regulations on archive administration by the civil affairs department of the people’s government above the county level.
  The Civil affairs department of the provincial people’s government shall establish and perfect the information system on administrative boundaries ,establish map storeroom and data bank in accordance with the administrative boundaries ,so as to provide the government and society with information service about the administration of administrative boundaries.
  Article 20. The disputes over the actual location of administrative boundaries between this province and adjacent provinces shall be settled by the relevant provisions of the country.
  The disputes over the actual location of administrative boundaries within this province shall be settled through negotiation by the relevant people’s governments whose administrative boundaries are adjacent to each other .Where an agreement is not reached through negotiation, the disputes shall be dealt with through coordination by the civil affairs department of the provincial people’s government ; if the civil affairs department of the provincial people’s government still fails in concluding the agreement through coordination , the civil affairs department of the provincial people’s government shall submit to the provincial people’s government for final settlement.
  Article 21. Any of state functionaries who, in violation of the provisions of these measures, commits one of the following acts in administering administrative boundaries shall be given the administrative sanction in the light of different circumstances; if such an act causes heavy loss to public property or the interests of the state or the people and constitutes a crime , the criminal responsibility shall be investigated and fixed according to law:
  (1) Failing to fulfill the duties laid dowm in the approval documents of and the agreement on administrative boundaries , or failing to implement the decisions of the organ that approved the administrative boundaries;
  (2) Moving or changing administrative boundary markers without authorization, or ordering or instigating others to commit such acts, or failing to stop others from committing such acts upon discovery of their commission of such acts;
  (3) Setting up or repairing without authorization administrative boundary markers in the absence of adjacent party concerned.
   Article 22. Where anyone , in violation of the provisions of these measures, diliberately damages or moves without authorization boundary stakes or other administrative boundary markers, he shall pay off the expenses for repairing such markers and be fined from 200 yuan to 1,000 yuan by the civil affairs department of the local people’s government  that administers such administrative boudaries ; if such act contitutes a violation of public security administration , he shall be given a penalty for public security violations according to law.
  Article 23. The administrative boundaries of townships , nationality townships and towns shall be administered with reference to the relevant provisions of these Measures.
  Article 24. The Measures shall be effective as of March 1, 2008.
